In this regard, there was an waver to article 1082 in 1376 based on which monetary dowry must be assessd according to the up-to-the miniute retes. Although some jurists do not allow dowry assessment, but in contrast to most of the jurists permitted it, and some are also believed to be a compromise between the parties. The research methodology in this study is the evidence proponents of dowry assessment. This present investigation tries to prove the necessity of observance of fairness as the reasons for the principles of assessment of updated dowry rate and to have a research into the followig issues: topical swerve from usury, convention , the law of condition, the law of responsibility, the law of innocent (not imposing losses on other people) and necessity of justice
