Out of the stipulations considered in fiqh books, there are two which make the most important ones: an illegal stipulation and a contrary-to-contract stipulation which bring about a variety effects. Most of fiqh scholars consider the contrary-to-contract stipulation an instance of an illegal stipulation. This article deals with these two stipulations, with their similarity and differences, as approached by Sunnite and Shiite experts
