In Islam, there is a significant emphasis on children’s rights, alongside a strong recommendation for fairness in judicial proceedings. According to established definitions, equity involves resolving disputes in a manner that is accepted by reason and conscience. This research, conducted through descriptive and analytical methods, examines the alignment of children’s rights with the principle of equity.
One prominent aspect of children’s rights is the consideration of expediency. In certain cases, the determination of expediency is entrusted to the court according to the law. However, since this concept does not universally apply to all matters related to children’s rights, invoking the principle of equity can greatly assist in better administering justice.
The objective of this research is to present findings on the application of the principle of equity in children’s rights. The results indicate that due to the close relationship between the concepts of expediency and equity, fairness has often been observed in meeting children’s physical and emotional needs. Generally, courts have the authority to issue rulings after assessing each child’s specific needs.
