The law regulations enjoy general foundations irrespective of the system in which they exist. The regulation of "unjust enrichment" is one of the causes of automatic liability in the legal system of France. There exists the same regulation, with a difference in conception of its Consideration and Cause, in Islam's jurisprudence too. Misunderstanding and lack of an enough acquaintance with Islamic jurisprudence has culminated in this illusion that the system is devoid of such a regulation; yet, the article in Iran's civil law have been derived from this undoubtedly existing regulation in Islamic jurisprudence.
The present article, comparing and contrasting Islam and France legal systems, studies the real sense and basis of some cases pertaining to the regulation in question. At the end the articles derived from the regulation in civil law of Iran have been mentioned too.
