Abstract

Being an undeniable principle in Islamic fiqh, first a discussion of the ghurur (deception) maxim is rendered, all supported by its fiqh arguments and its instances in fiqh as well as in subjective laws. To crystallize this maxim, there are a few factors at work such as cheating and a causal relation between the attempts of the cheater and the cheated. Once all conditions met, the cheated person can go to the cheater to get the compensation required. Aside from the body of traditions available, it seems logical for the cheated to go to the cheater. In subjective laws, one of the reasons for guarantee is cheating and deception. The present study draws on the developments done by the late Imam Khomeini
