Re-analyzing the Position of Jurisprudence of Sayings in Imam Khomeini's Method of Ijtihad

Abstract

In the field of ijtihad, it may initially appear that examining the statements of jurists is not crucial for juridical deduction. However, it must be acknowledged that the process of deduction without referring to juristic opinions is often ineffective, especially in complex issues with multiple dimensions. Engaging with the jurisprudence of jurists’ statements offers several advantages, including facilitating ijtihad, enhancing its quality, and minimizing errors. Based on these premises, the present study aims to explain and analyze the methods of engaging with juristic statements, focusing on the role and mechanisms of these statements within Imam Khomeini’s jurisprudential approach. Utilizing an analytical-descriptive methodology, this paper identifies the strategies employed by jurists, which include: analyzing each statement individually, considering a collection of statements, and evaluating statements in relation to their historical emersion. According to the findings, Imam Khomeini’s approach to juridical deduction incorporates four key mechanisms: 1. Perspectives (vision, thought, theory), 2. Information, 3. Techniques, and 4. Organizing.
