Naturally different causes and factors have played role in the process. This article is seeking to define the roles played by time, place, and other influential factors and having presented an example of jurisprusential issues about "cutting the young boy’s hand" it discusses the influential factors. First, it deals with the importance of analyzing this matter. Next, it examines the ruling of cutting the young boy’s hand as an example in three parts. Primarily, it examines the reliable traditions about cutting the young boy’s hand when he commits stealing. Next, the different periods of jurisprudence are reviewed.  It then examines the jurisprudents' standing against such traditions and the rulings issued by them regarding this matter, including both the cons and pros of cutting the hand. Next, it makes a reference to the arguments of the opponents of this ruling in spite of the reliable evidences existed regarding this matter. Finally, it focuses on the role played by time and place, as well as the conduct of the wise, and the reason.    برخی از احکام فقهی در گذر زمان دستخوش تغییراتی شده‌اند. طبعاً علل و عوامل مختلفی در این امر دخیل بوده است. در این مقاله به‌دنبال عوامل تأثیرگذار و نقش زمان و مکان در آنیم و با ارائۀ یک نمونه از مباحث فقهی دربارۀ «قطع ید صبی» به این عوامل تأثیرگذار می‌پردازیم. در ابتدا به اهمیت واکاوی این مسئله، سپس با نگاه به حکم قطع ید صبی، به‌عنوان یک نمونه در سه قسمت پرداخته شده است. نخست به بررسی روایات دال بر قطع ید صبی هنگامی که مرتکب سرقت می‌شود و مروری بر ادوار فقه، سپس به موضع فقیهان در برابر این روایات و فتاوایی که در خصوص این موضوع صادر کرده‌اند، اعم از موافقان و مخالفان قطع ید و آنگاه به دلایل مخالفان این حکم با وجود ادلۀ معتبری که در این زمینه وجود داشته، اشاره و در پایان به نقش زمان و مکان و بنای عقلا و عقل توجه شده است. https://jorr.ut.ac.ir/article_73846_e51968f505e68bf242ba91b9130e2a90.pdf
