During this period, in spite of the fact that the daughter is the legitimate and legal wife of her husband, indeed she lives in her father’s house or a house other than her husband’s. This social procedure demands special jurisprudential and legal rules and laws pertaining to how the spouses should observe their rights during this period. One of the issues is the wife’s leaving home without permission of her husband. The question arises here as to whether during this period, like the joint life of the spouses, it is an obligation for the wife to take permission of her husband for leaving home? To answer the question, this article first explains the rights of spouses and the views of jurisprudents pertaining to the obligation or lack of obligation for taking permission during engagement period. Next, discussing and criticizing the arguments of those who hold that it is obligatory to take permission from jurisprudential perspective relying on mentally established condition, concomitant of right and responsibility, custom, and using lien right as well as from legal perspective relying on the juristic unification vote, it is concluded that it is not necessary for the wife to take permission of her husband during engagement period.                    در عرف کنونی جامعۀ ایران معمولاً میان عقد ازدواج و شروع زندگی مشترک زوجین، فاصلۀ زمانی وجود دارد که به آن دوران عقدبستگی می‌گویند، در این بازه زمانی دختر علیرغم اینکه همسر شرعی و قانونی زوج محسوب می‌شود، عملاً در منزل پدر یا منزلی غیر از مسکن شوهر سکونت دارد، این رویّۀ اجتماعی احکام و قانون‌های فقهی و حقوقی ویژه‌ای در ارتباط با چگونگی رعایت حقوق زوجین در این بازۀ زمانی را می‌طلبد که از جمله مسئلۀ خروج زوجه از محل سکونت خود بدون اسیتذان از شوهر یکی از این موارد است و در این مجال پرسشی مطرح می‌شود که آیا در این دوران نیز همانند دوران زندگی مشترک، استیذان از زوج برای خروج از منزل واجب است یا خیر؟ در این مقاله برای پاسخ به این سؤال ابتدا به بیان حقوق زوج و طرح نظریات فقها در رابطه با وجوب یا عدم وجوب استیذان در دوران عقد پرداخته شده و سپس با طرح و نقد دلایل قائلان به وجوب استیذان، از منظر فقهی با استناد به شرط ارتکازی ضمنی، ملازمۀ بین حق و وظیفه، عرف رایج و استفاده از حق حبس و از منظر حقوقی با استناد به رأی وحدت رویّۀ دیوان عالی کشور، عدم لزوم استیذان زوجه از شوهر برای خروج از منزل در دوران عقد‌بستگی برگزیده شده است.. https://jorr.ut.ac.ir/article_71366_6269b2d5cbb8ec66cecaaff7d81fad89.pdf
