The writer exposed to wording which demonstrate holistically SAHEB MADAREK resorted to argument of rightful certainty, thereby he applies those reasons to prove sharia decree according to the scrutiny and analysis of words of MADAREKOLAHKAM book as new finding accessible by the current writer. Meanwhile there are stories narrated by him which the skepticism in credentiality is inferred from those words, hence the whole stories are reasonable which attributed to other meanings. این مقاله به تحلیل و بررسی اندیشۀ اصولی صاحب مدارک (ره) در باب حجیت استصحاب یا عدم آن می‌پردازد. اگرچه از صاحب مدارک (ره) هیچ اثر اصولی در دست نیست تا بر اساس آن بتوان در ارتباط با دیدگاه وی در این مسئله اظهارنظر کرد، لکن بسیاری از فقها و اصولیون بعد از وی، مستند به برخی از عبارات ایشان در کتاب مدارک الاحکام، وی را از زمرة منکران حجیت استصحاب تلقی کرده و قول به عدم حجیت مطلق استصحاب را به ایشان نسبت داده‌اند. نویسنده با تتبع و بازخوانی کتاب مدارک الاحکام به عبارتی دست یافته است که صراحتاً نشان می‌دهد صاحب اثر در مواضع متعدد، برای اثبات مختار خود به دلیل استصحاب تمسک جسته و از این دلیل برای اثبات حکم شرعی بهره برده است. ضمن آنکه عباراتی از ایشان که شائبة انکار حجیت استصحاب از آن تلقی شده است، همگی شایان توجیه بوده‌اند‌ و محمول بر معانی دیگر هستند. https://jorr.ut.ac.ir/article_67649_6907625acadbd06c20d576548553ab53.pdf
