Accordingly, the marriage formation, agreement and contract are ceremonial affairs with special rules and regulations. Islamic jurisprudential rules and regulations have also specified certain conditions for this ceremonial contract. Among these issues is the circumstance and the rule for a Muslim marrying a non-Muslim. The famous theory of the jurisprudents holds that: A Muslim woman does not have the right to marry a non-Muslim man under any circumstances. And also, the Muslim man cannot marry permanently a non-Muslim woman. Of course, in the case of a temporary marriage of a Muslim man and a non-Muslim woman and the birth of a child, the child is attached to the Muslim man. There are very controvertial views, questions, and doubts regarding the jurisprudential evidences of this matter. The present paper, using a descriptive content-analysis methodology, library tools, research data and notes reviews the jurisprudential documents of this matter and answers a number of questions in this regard. مسئلۀ ازدواج یکی از حساس‌ترین ، اجتماعی‌ترین و نهادی‌ترین برنامه‌های مدنی هر فرهنگ و ملت است. بر همین اساس، شکل‌گیری قرارداد وعقد ازدواج امری تشریفاتی و عقدی دارای ضوابط خاص محسوب می‌شود. در قانون‌های و مقررات فقهی اسلامی نیز، شرایط و ویژگی‌های خاصی برای این قرارداد تشریفاتی در نظر گرفته شده که از جملۀ این مباحث، چگونگی و حکم ازدواج مسلمان با غیرمسلمان است. نظریۀ مشهور فقها، این بوده که زن مسلمان در هیچ شرایطی حق ازدواج با مرد غیرمسلمان را ندارد و همچنین مرد مسلمان هم نمی‌تواند به‌صورت دائم با زن غیرمسلمان ازدواج کند. البته در صورت ازدواج غیردائم مرد مسلمان با زن غیرمسلمان و پیدا شدن فرزند، بچه ملحق به مرد مسلمان است. در خصوص مستندات فقهی این مسئله دیدگاه‌های مخالفی مطرح شده و ابهامات و سؤالاتی چند در بین است. مقالۀ حاضر به روش توصیفی - تحلیلی محتوایی و با ابزار کتابخانه‌ای و داده‌های مطالعاتی و فیش‌های تحقیقاتی، مستندات فقهی مسئلۀ مزبور را بازپژوهش کرده و به سؤالات چندی در این زمینه پاسخ داده است. https://jorr.ut.ac.ir/article_66669_95e964786fd5892aa149aab29d1db5ed.pdf
