With the advent and prevalence of Mass Media, the scope of crimes against spiritual character of people has broadened and created new challenges for the researchers in the area of jurisprudence and law. This study tries to see whether the concept of <em>qadhf</em> is applicable to some widespread crimes that occur in Mass Media. Thus, first the concept of <em>qadhf</em> is defined and its conditions are explained. Based on the definition, <em>qadhf</em> is applicable to written sexual accusations, sexual accusations found on the internet and also pornography. Factors such as wider audience, slander on people’s honor, promotion of prostitution, retention and playback capabilities and also the role that Media can play in directing pop culture can be considered as aggravating circumstances that justify a more severe punishment of <em>qadhf</em> in Mass Media in comparison with ordinary <em>qadhf</em>. یکی از مهم‌ترین جرایم علیه شخصیت معنوی افراد، اتهامات جنسی است که در معنای خاص خود «قذف» نامیده می‌شود. با پیدایش و گسترش روزافزون رسانه‌های همگانی، جرایم علیه شخصیت معنوی افراد نیز دامنۀ گسترده‌تری پیدا کرد و مسائل جدیدی را فراروی پژوهشگران فقه و حقوق قرار داد. در این نوشتار تلاش شده است امکان صدق مفهوم «قذف» بر برخی از جرایم رسانه‌ای شایع بررسی شود. لذا نخست به مفهوم‌شناسی جرم قذف پرداخته شده است و ارکان تحقق آن تبیین شده‌اند. با توجه به تعریفی که از جرم قذف ارائه شده است، قذف نوشتاری، و قذف توسط نمایه‌ها، پورنوگرافی‌ها و هرزه‌نگاشته‌ها نیز می‌توانند مصداق جرم قذف باشند. عواملی نظیر کثرت مخاطبان، هتک آبروی افراد، اشاعۀ فحشا، قابلیت ابقا و بازپخش و نقش‌آفرینی رسانه‌ها در جهت‌دهی فرهنگ عمومی، به‌عنوان موجبات تشدید مجازات جرم قذف رسانه‌ای نسبت به قذف عادی قلمداد می‌شوند. https://jorr.ut.ac.ir/article_66666_ab7ed51241558880df3fb5b11d9783ee.pdf
