These two areas of science have similarities and differences. As yet, although many decision have been made about the relationship of “jurisprudence”, “ethics” and “mysticism”, it is hard to achieve the common conclusion through all these decisions, while the judgment of any of the researcher is based on their perception of the meaning of “Jurisprudence”, “ethics”. Therefore, understanding relationship, homogeneity and heterogeneity of jurisprudence and ethics, requires determining different aspects of these two areas. This study aims to explain the necessity to separate different meaning of “jurisprudence” term meanwhile, reveals the homonym of different application of “jurisprudence” term and eventually discuss the relationship among different meanings and the relation of “jurisprudence” and “ethics” and compare their role in human.           علم «فقه» و «اخلاق» هر کدام عهده‌دار تأمین بخشی از کمال انسان هستند. این دو علم اشتراکات و اختلافاتی دارند. تاکنون داوری‌های بسیاری دربارۀ نسبت میان فقه و اخلاق و عرفان صورت گرفته است، لیکن به‌سختی می‌توان از میان این همه، به نتیجۀ واحدی دست یافت، چه آنکه داوری هر کدام از پژوهشگران در این نسبت‌سنجی، بر تلقی ایشان از معنای «فقه» و «اخلاق» مبتنی بوده است. بنابراین درک رابطه، تشابهات و تمایزات «فقه» و «اخلاق» نیازمند تبیین جهات و حیثیات مختلف این دو علم خواهد بود. در این نوشته بر آنیم که ضمن تبیین ضرورت تفکیک معانی «فقه» در کاربردهای مختلف آن، پرده از اشتراک لفظی معانی و کاربردهای مختلف لفظ «فقه» برداریم و در نهایت ارتباط میان این معانی بحث خواهد شد و به رابطۀ بین «فقه» و «اخلاق» و مقایسۀ جایگاه این دو علم در رسیدن به کمال می‌پردازیم. با توجه به موضوع تحقیق، از روش تحلیلی، توصیفی و استنباطی بر اساس منابع موجود در کتاب‌های فقهی و اخلاقی استفاده شده است.     <strong><br clear="all" /> </strong> https://jorr.ut.ac.ir/article_61115_5a1ce3552e8ba75f2a31eacb81706ac3.pdf
