The author of this article verified the evidences of the said principle and carefully considered the contents and purports thereof and believes that "Justice and Equity" as a jurisprudential principle and a canonical evidence shall be invalid and ineffective</em><em>.       </em> <em>This article has been written as to the aforesaid subject and aimed at defending the writer's opinion</em><em>.،</em><em> </em><em> </em>                                     در تقسیم اموال یا حقوق میان فقیهان از قاعده‌ای فقهی با نام «قاعدۀ عدل و انصاف» نام برده شده است. به استناد این قاعده فقها می‌گویند: هرگاه مال یا حقی میان دو شخص یا بیشتر مردد بوده و هیچ‌یک از طرفین بیّنه‌ای نداشته باشند یا آنکه بیّنه‌ها با هم معارض باشند و اماره‌ای بر اختصاص مال یا حق به شخص خاصی در میان نباشد، بر اساس قاعدۀ عدل و انصاف حکم به تقسیم بالسویۀ اموال یا حقوق بین اشخاص می‌شود. صاحبان این قلم پس از بررسی مستندات قاعده و با تأمل در مدلول و مفاد آن، معتقدند: «عدل و انصاف» ذیل قاعده‌ای فقهی و به‌عنوان مستند فتاوی شرعی، فاقد وجاهت است و ادله را یارای تأمین آن نیست. این مقاله در راستای مختار موصوف و با هدف دفاع از موضع نگارندگان سامان یافته است.       https://jorr.ut.ac.ir/article_61114_486dcfbc0c875a04ae8fe2c5896c51c9.pdf
