Regardless of the issues of the ownership of personal data, an important question is raised: Does benefiting from communicative data of individuals carry any responsibilities or not? The responsibility ensuing the collection, processing and sale of personal data by commercial companies and individual persons might be noted from different aspects. And various instruments could be employed to protect the owner of the data. Benefiting, along with some other factors, could be noted as a cause of liability for violating the rights of the owner of the communicative data. Liability for benefiting from individuals’ communicative data and its conditions constitute the topic of the present text.     ممکن است داده‌های فردی اشخاص، به‌ویژه در حوزۀ ارتباطات، به‌وسیلۀ شرکت‌های تجاری، تحصیل و پس از پردازش، بر اساس نیاز بازار مصرف، در قالب پروفایل‌های تجاری درآید و به مشتریان عرضه شود. صرف‌نظر از مباحث مربوط به مالکیت داده‌های فردی، این پرسش مهم مطرح می‌شود که آیا استفاده از داد‌ه‌های ارتباطی مربوط به افراد، مسئولیتی به‌دنبال دارد یا خیر؟ مسئولیت ناشی از اقدام شرکت‌های تجاری و سایر اشخاص، در تحصیل، پردازش و فروش داده‌های فردی، ممکن است از جهات گوناگون مورد توجه قرار گیرد و از اسباب متنوعی برای حمایت از شخص موضوع داده مدد گرفته شود. در این میان به‌نظر می‌رسد استیفا در کنار برخی عناصر دیگر، به‌عنوان یکی از موجبات ضمان ناشی از نقض حقوق شخص موضوع دادۀ ارتباطی مورد توجه قرار می‌گیرد. ضمان ناشی از استیفا از داده‌های ارتباطی افراد و شرایط آن، موضوع نوشتار حاضر است   <strong> </strong>   https://jorr.ut.ac.ir/article_61110_1c6f650f892ad81b737cf7162c71538b.pdf
