Exigencies of time and place are the fundamental determiners for addressees of religious commandments. These subjects function as causes for commandments; consequently, there exist many different views as regards the impact of setting in religious commandments. The article is intended to study and explore the concept of setting and its part in discretion, the one which redounds to dynamism of the Islamic jurisprudence in every places or span of time, presenting its importance. مقاله‌ی حاضر به بررسی نقش زمان و مکان در اجتهاد می‌پردازد. مقتضیات زمان و مکان در تعیین موضوع احکام نقش اساسی دارند و موضوعاتِ احکام به مثابه علت برای حکم است. از این رو نظریه‌های مختلفی درباره‌ی تأثیر زمان و مکان بر احکام شرعی وجود دارد. جهت‌گیری این نوشتار بررسی مفهوم زمان و مکان و نقش این دو، در اجتهاد است که موجب پویایی فقه در همه زمان‌ها و مکان‌ها می‌گردد و چنین رویکردی اهمیت پرداختن به این موضوع را نشان می‌دهد. https://jorr.ut.ac.ir/article_18730_b80472fb2d8590278f3fb95a9f97b4cc.pdf
