It holds that when an individual warns others of the potential danger of his or her actions, and they disregard the warning, that individual is exempt from responsibility for any resulting harm. Contemporary jurists have treated this warning as an independent basis for exemption from liability. However, in view of other established doctrines such as <em>tasbib</em> (causation through indirect contribution), this study seeks to determine whether the warning rule truly constitutes an independent principle establishing a distinct criterion for liability, or whether it is merely a specific instance of <em>tasbib</em>. Using a descriptive-analytical methodology, the study examines the textual and rational foundations of the warning rule — namely the Qur’an, the Sunnah, and rational construct — to infer whether it forms an autonomous legal institution. The findings reveal that the warning rule does not represent an independent ground for exemption from liability but is rather a manifestation of <em>tasbib</em>, as neither the Qur’an nor the Sunnah provides evidence for such independence, and rational constructs likewise fail to substantiate it. قاعدة موسوم به تحذیر یا هشدار از قواعدی است که در سالیان اخیر به عنوان یکی از نهادهای رافع مسئولیت در پژوهش‌های محققین مطرح شده و منظور از آن این است که اگر فردی نسبت به خطرات فعل خود به دیگران هشدار دهد اما دیگران توجه نکنند و آسیب ببینند فرد هشداردهنده مسئولیتی ندارد. حقوق‌پژوهان معاصر هشدار را به عنوان یک عامل مستقل در رفع مسئولیت معرفی کرده‌اند؛ لیکن با توجه به وجود سایر نهادهای رافع مسئولیت، مانند تسبیب، مسئله‌ای که نویسندگان پژوهش حاضر درصدد پاسخگویی به آن هستند این است که آیا هشدار یا تحذیر عاملی مستقل است و معیاری متفاوت برای رفع مسئولیت ارائه می‌دهد یا اینکه از مصادیق نهاد تسبیب محسوب می‌شود؟ پژوهش حاضر به روش توصیفی‌ـ تحلیلی ادلة قاعدة هشدار، که شامل قرآن و سنت و بناء عقلا می‌شود، را با رویکرد  امکانِ استنباطِ نهادی مستقل برای رفع مسئولیت، ارزیابی می‌کند و رهاورد آن این است که هشدار عاملی مستقل برای رفعِ مسئولیت نیست و در حقیقت از مصادیق قاعدة تسبیب است. زیرا قرآن کریم اساساً دلالتی بر رفع مسئولیت نمی‌کند و سنت و بناء عقلا دلالتی بر نهادی مستقل از تسبیب نمی‌کنند. https://jorr.ut.ac.ir/article_101404_80ed303c688187aeadc15e8b1d5d0671.pdf
