Although the jurists agree on the preference of hoarding, they disagree on its defining law. The majority of the jurists agree that it is unlawful. However, a number of jurists hold that it is abominable. Of course, the sound view is the dominant doctrine, because the narrations on cursing and punishing the hoarders on the one hand, and paralleling them with thieves and drinkers on the other hand are not in any way consistent with abomination. Although the dominant doctrine among the jurists based on the contents of Sakouni,s tradition restricts hoarding to six items including wheat, barley, date, curry, vegetable oil and olive oil, it seems that the words should not be restricted and a broader scope of hoarding should be considered. Since according to Imam 'Ali,s  Covenant to Malik Ashtar in which hurting others is expressed as the criterion of hoarding as well as the no-harm rule hoarding cannot be restricted only to these items, but it also includes other needed non-food items.}, keywords = {hoarding,Islamic jurisprudence,Alawi's Conduct,Cases of Hoarding,No-Harm Rule}, title_fa = {احتکار در فقه اسلامی و سیرۀ علوی و بررسی قول مشهور در سعه و ضیق موارد آن}, abstract_fa = {با توجه به روایات و کتاب‌های فرهنگ لغت، خرید یا ذخیره کردن آذوقۀ مورد نیاز مردم و جلوگیری از عرضۀ آن به‌منظور گران شدن قیمت، احتکار به‌شمار می‌آید؛ فقها با اینکه همگی در مرجوح بودن احتکار، اتفاق نظر دارند، در حکم تکلیفی آن هم‌رأی نیستند، نظر مشهور حرمت است؛ ولی برخی بزرگان فقه آن را مکروه می‌دانند؛ البته نظر درست همان قول مشهور است، چراکه روایات لعن و مجازات محتکران از طرفی، و در ردیف قرار دادن آنان با شاربان خمر و سارقان از طرف دیگر، به‌هیچ‌وجه با کراهت سازگاری ندارد؛ اگرچه مشهور بین فقها، احتکار بنابر مفاد روایت سکونی، منحصر در شش مورد گندم، جو، خرما، مویز، روغن نباتی و روغن زیتون است، به‌نظر می‌رسد نباید جمود بر الفاظ کرد و باید گسترۀ احتکار را بیش از آن دانست؛ چراکه به موجب عهدنامۀ امام علی(ع) به مالک اشتر که در آن ملاک احتکار ضرر به دیگران ذکر شده است و نیز با توجه به قاعدۀ لاضرر، احتکار نمی‌تواند به موارد مزبور منحصر باشد، بلکه موارد ضروری غیرخوراکی را نیز شامل می‌شود.}, keywords_fa = {احتکار,سیرۀ علوی,فقه اسلامی,قاعدۀ لاضرر,موارد احتکار}, url = {https://jorr.ut.ac.ir/article_84312.html}, eprint = {https://jorr.ut.ac.ir/article_84312_084dccf8f26ca75ede6e49dc7da4d3c0.pdf} }
