He claims that the Shari'a does not have a ruling on women's clothing, and that the narrations' putting emphasis on women's hijab was related to the observance of society's custom, and that free women covered their hair to distinguish themselves from slaves. So far, there is no comprehensive analysis of the author's historical and narrative evidences on the issue of women’s hair covering. Therefore, using an analytical-descriptive method, the present article analyzes the arguments of the book. The results of this survey show that the author’s perception of the hadiths relating to the hijab of Lady Fatimah Zahra (S) and women in Karbala is unilateral and incompatible with their code of behavior. Most of evidences against the obligation of hijab for female slaves suffer from weak isnad and inconsistency with other arguments, and the author’s interpretation of al-Ahzab:59 violates the Islamic equality and is rejected by many Shi'a and Sunni exegetes. Finally, some counter-arguments, such as the perception of “khimar” by the most of the women of Muhajir and Ansar and many hadiths concerning the subject, prove the necessity of hijab for women in Islamic shari'a and reject the arguments mentioned in the book. }, keywords = {hijab,Covering of Women’s Hair,Maidservant,Book "Islamic Code of Hijab at the Time of the Prophet (PBUH)"}, title_fa = {نقد ادلة عدم الزام پوشش موی زنان در کتاب حجاب شرعی در عصر پیامبر(ص)}, abstract_fa = {مسئله حجاب از موضوعات چالش‌برانگیز در عصر حاضر است و نویسندگان مختلف با رویکردهای متفاوت در رد و تأیید آن مطالبی را نگاشته‌اند. کتاب حجاب شرعی در عصر پیامبر(ص) نوشتة امیرحسین ترکاشوند، با رویکرد نفی الزام حجاب شرعی و با استناد به گزارش‌های روایی، تاریخی و فقهی به رشتة تحریر درآمده است. وی مدعی است که شریعت دربارة پوشش زنان حکمی ندارد و تأکید روایات بر حجاب بانوان ناظر به رعایت عرف جامعه و نیز تمایز از کنیزان بوده است. تاکنون تحلیلی تفصیلی دربارة دیدگاه نویسنده در خصوص پوشش مو و مستندات تاریخی و روایی آن صورت نگرفته است؛ ازاین‌رو نوشتة حاضر، با روش تحلیلی- توصیفی به بررسی مستندات مسئله پرداخته است. نتایج پژوهش نشان می‌دهد که برداشت نویسنده از روایات ناظر بر پوشش حضرت زهرا(س) و زنان حاضر در کربلا، یکجانبه و با سیرة رفتاری آنها ناسازگار است. عمده شواهد ارائه‌شده برای عدم وجوب پوشش کنیز، دچار ضعف سندی و یا تعارض با سایر ادله است و تفسیر نویسنده از آیة 59 سورة احزاب نیز افزون‌بر تضاد با روح مساوات اسلامی، مورد انکار بسیاری از مفسران فریقین قرار گرفته است. در پایان، شواهدی چون برداشت معنای پوشش موی سر از واژة «جلباب» توسط عموم زنان مهاجر و انصار و روایات فراوانی که در این ‌باره وجود دارد، وجوب پوشش موی سر اثبات شده است. ضمن رد استدلالات این کتاب و بیان سایر مستندات، وجوب شرعی پوشش موی سر را اثبات کرده است.}, keywords_fa = {پوشش موی زنان,حجاب,حجاب کنیز,کتاب حجاب شرعی در عصر پیامبر(ص)}, url = {https://jorr.ut.ac.ir/article_77675.html}, eprint = {https://jorr.ut.ac.ir/article_77675_5fa6deebcb0dca7055f023abeece1e47.pdf} }
