Because in the process of organ transplantation and the transmission of contagious diseases we face three pillars of the medical staff, the transmitter, and the transmitted or the victim, we should separately examine the extent of each of the criminal liabilities. There is a controversy over the responsibility of the mentioned bodies in terms of jurisprudence and the law and the procedures of the courts. The jurisprudents hold that the physicians are responsible in all circumstances, but the law and the procedures of the courts do not hold him accountable to the prescribed conditions (observance of technical regulations or taking acquittal) in the law and their observance by the physician. The current jurisprudential and legal views hold that according to the type of disease transmitted and its being fatal or non-sedentary, as well as in the view of the existence of a criminal intention (mens rea) of depriving the life of or sustaining a physical harm to the patient, as well as a criminal blame, (recklessness, negligence, etc.) the penalty will be different. In addition, considering the medical requirements before transplantation, the faults of the medical staff should be specifically considered.}, keywords = {Criminal Liability,Organ Transplantation,Transmission of Disease,Fault}, title_fa = {جستاری در مسئولیت کیفری انتقال بیماری‌های مسری از طریق پیوند عضو}, abstract_fa = {مسئولیت کیفری انتقال بیماری‌های مسری در پیوند عضو، یکی از مباحث چالشی و نیازمند دقّت علمی در این زمینه است. از آنجا که در فرایند پیوند عضو و انتقال بیماری‌های مسری، با سه رکن اساسی کادر پزشکی، منتقل و منتقل‌ٌالیه یا همان مجنی‌ٌعلیه مواجهیم، به ناچار باید جداگانه به بررسی میزان مسئولیت کیفری هر کدام بپردازیم. نسبت به مسئولیت ارکان مذکور از منظر فقه و حقوق و رویّۀ محاکم، اختلاف نظر وجود دارد. فقها در هر شرایطی پزشک را مسئول می‌دانند، اما قانون و رویّۀ محاکم با شرایط مقرر در قانون (رعایت نظامات فنی یا گرفتن برائت) و رعایت آنها توسط پزشک، وی را مسئول نمی‌دانند. برایند دیدگاه‌های فقهی و حقوقی موجود آن است که با توجه به نوع بیماری منتقل‌شده و کشنده یا غیرکشنده بودن آن و نیز با توجه به وجود قصد مجرمانۀ سلب حیات یا ورود صدمۀ بدنی و نیز تقصیر جزایی (بی‌احتیاطی، بی‌مبالاتی و ...) مجازات، متفاوت خواهد بود. علاوه بر این با توجه به الزامات پزشکی قبل از پیوند، باید قصور کادر پزشکی به‌طور ویژه مورد نظر قرار گیرد.}, keywords_fa = {پیوند عضو,قصور,مسئولیت کیفری}, url = {https://jorr.ut.ac.ir/article_73851.html}, eprint = {https://jorr.ut.ac.ir/article_73851_8629d9e242c2ba0f0c6e0f9e58916565.pdf} }
