By evidences we mean the documents that prove that a certain rule is God’s command and according to expression of the jurists the reason for issuing a rule is not related to the mysteries of rules and the philosophy which is concealed in its issuance. The jurist is not obliged to unveil these secrets, however the increasing expansion of communities, versatility, and plurality of the necessary issues in the society have proven that reliance on the evidences doesn’t fulfill the needs of the society and one cannot expect that there should be a reason from among the legal evidences for every social necessary issue. Therefore, it will be inevitable to seek help of the reasons of legal evidences to determine the religious task at the time of silence or ambiguity or religious rules and to generalize the existing rules to other cases by means of reason or in the cases when the reason is resolved the rules also have to be resolved and to expand or spoil religious rules. This important issue necessitates that the jurists do not suffice to express the evidences and to take a step toward etiology. The present study aims at explaining the accurate meaning of the reason and the necessity to explore and explain the reasons of rules and consequences of incorrect etiology to prepare the ground for the movement of jurisprudence from explaining the evidences to explaining the reasons and to provide the fundamentals of establishing the evidential jurisprudence through identifying the correct methods of reason exploration. By doing this, it can help and improve the evidential jurisprudence and can prevent from undesirable effects of unprofessional reasoning for rules.}, keywords = {reason,philosophy,jurisprudence,Evidence,Basis}, title_fa = {از فقه ادله تا فقه علل}, abstract_fa = {بر اساس تعریف‌های مرسوم، علم فقه برای بیان و تبیین احکام و ادلۀ آنها طراحی شده و مقصود از ادلۀ احکام مدارکی است که اثبات کند حکم مورد بحث، نظر خداوند است و مطابق اصطلاح فقها، دلیل حکم به راز و رمز صدور احکام و حکمت نهفته در صدور آن نظر ندارد و فقیه خود را به کشف این اسرار موظف نمی‌داند، اما گسترش روزافزون جوامع و تنوع‌پذیری و تکثر مسائل مورد نیاز جامعه ثابت کرده است که اکتفای به ادله، نیاز جامعه را مرتفع نمی‌کند و نمی‌توان انتظار داشت که برای هر مسئلۀ مورد نیاز، دلیلی از ادلۀ شرعی وجود داشته باشد و به ناچار باید برای تعیین تکلیف شرعی در موارد سکوت یا ابهام شریعت، از علت احکام شرعی مدد جست و با استفاده از علت‌ها، احکام موجود را به موارد دیگر تعمیم داد یا در مواردی که علت مرتفع می‌شود، احکام را نیز مرتفع و احکام شرعی را توسیع یا تضییق کرد و این مهم، اقتضا دارد که فقها از اکتفاء به بیان ادله دست بردارند و گامی در وادی علت‌شناسی نیز بگذارند. در این تحقیق ‌کوشش می‌شود تا با تبیین دقیق معنای علت و ضرورت کشف و تبیین علل احکام و عوارض ناشی از علت‌یابی‌های نادرست، زمینه‌ساز حرکت علم فقه از بیان ادله به بیان علت‌ها باشد و با شناسایی روش‌های درست کشف علت، شالودۀ تأسیس فقه علل را فراهم کند و از این طریق، مددکار فقه ادله و موجب ارتقای آن باشد و از بروز عوارض ناپسند علت‌سازی‌های غیرکارشناسانه برای احکام پیشگیری کند.}, keywords_fa = {حکمت,دلیل,علت,فقه,مناط}, url = {https://jorr.ut.ac.ir/article_73804.html}, eprint = {https://jorr.ut.ac.ir/article_73804_a4b17ce543b88b6d9cbbd63ec8f7c50b.pdf} }
