Now the question arises here as to whether it is permissible to give a gift to the judge considering his sensitive position. The present article, using a library and descriptive-analytical method, has established that the Islamic jurisprudents are disagree on this matter: some of the latest Shi'a jurisprudents hold that it is absolutely lawful. They believe that the narrations stating the unlawfulness of giving gift are weak and cannot be argued upon. In contrast, most of Maleki jurisprudents have regarded it absolutly unlawful for the prohibition of what may lead to committing sin. Some other like Abu-Hanifeh and his pupils hold that it is abominated; in their opinion, prevention stated in the Clear texts express abomination but not prohibition. Most of the earlier Shi'ite  jurisprudents, nearly all of the Shafe’i and Hanbali jurisprudents, some of the Hanafi and Maleki jurisprudents hold that it needs explanation and believe that giving gift to the judge in different conditions have different verdicts. It seems that this opinion is superior, and the criteria for explanation are the intention of the gift giver and the judge, the existence of former relationship between the judge and the gift giver, the gift giver’s having a case before the judge, the existence of former history of giving gift to the judge by the gift giver, and the amount of the gift paid to the judge before and after being appointed as judge.  }, keywords = {Bribe,jurisprudence,Judge,Five Islamic Schools of Thought (al-madahib khamsah),Gift}, title_fa = {مطالعۀ تطبیقی حکم هدیه به قاضی در فقه مذاهب خمسه}, abstract_fa = {در مورد استحباب هدیه اختلافی وجود ندارد. اکنون این سؤال مطرح است که با توجه به جایگاه حساس قاضی، آیا هدیه دادن به او نیز جایز است؟ مقالۀ حاضر که به روش کتابخانه‌ای و به شیوۀ توصیفی ـ تحلیلی سامان ‌یافته، مشخص کرده است که فقهای مذاهب اسلامی در این باب به شرح زیر اختلاف‌ نظر دارند: برخی از فقهای متأخر شیعه قائل به جواز مطلق آن شده‌اند. آنها معتقدند که روایات دال بر حرمت، ضعیفند و احتجاج‌پذیر نیستند. در مقابل بیشتر فقهای مالکی من‌باب سد ذریعه مطلقاً آن را حرام دانسته‌اند. ابوحنیفه و شاگردانش قائل به کراهت شده‌اند. از نظر آنان نهی وارده در نصوص، بر کراهت دلالت دارد نه حرمت. بیشتر فقهای متقدم شیعه، اکثر شافعیه و حنابله، عده‌ای از حنفیه و مالکیه قائل به تفصیل شده‌اند و معتقدند هدیه به قاضی در حالت‌های مختلف، احکام مختلفی دارد. به‌نظر می‌رسد قول به‌تفصیل، راجح باشد و ملاک در تفصیل، نیت هدیه‌دهنده و قاضی، وجود رابطۀ قبلی میان قاضی و هدیه‌دهنده، وجود پرونده‌ای از هدیه‌دهنده نزد قاضی، وجود سابقۀ قبلی هدیه به قاضی و میزان هدیه‌ای است که قبل و بعد از تصدی منصب قضا، توسط هدیه‌دهنده به قاضی پرداخت می‌شود.}, keywords_fa = {رشوه,فقه,قاضی,مذاهب خمسه,هدیه}, url = {https://jorr.ut.ac.ir/article_68824.html}, eprint = {https://jorr.ut.ac.ir/article_68824_583849f8f651ffa58e7b6cbc6da99138.pdf} }
